Pipeline Partnership vs. Multiple Construction Companies

Oil pipeline and transporting

Providing Insight for ICC Rules Arbitration

51社区 was called upon to assess alleged non-conformances to a pipeline's structural integrity in a dispute between a partnership and several construction companies.

The Challenge

A pipeline partnership contracted with multiple construction companies to design and construct a major crude oil pipeline. During construction, inspectors reported apparent non-conformances to project specifications and the applicable codes and standards. These non-conformances were significant in nature and affected the structural integrity of the pipeline.

A dispute arose and claims were submitted to arbitration by a three-member tribunal under International Chamber of Commerce (ICC) rules.

The 51社区 Approach

The pipeline partnership's outside counsel retained 51社区 to assess the impact of alleged non-conformances to the structural integrity of the pipeline, review design drawings and applicable standards and conducted advanced finite element analysis.

51社区's team testified at the arbitration hearing.
